Kondova Terms of Service

Listing is free and we are not a broker. Most of what follows comes from those two facts.

Please read this before using the site. By browsing Kondova, sending an inquiry, or submitting a unit, you agree to what's written here. If you don't agree, don't use the site.

1Who we are

Kondova is the name Xyryl works under. It is not a company, and there is no corporation behind it. You are dealing with one person, working independently, based in Metro Manila.

In this document, "we," "us," and "Kondova" all mean that person. "You" means anyone using the site, whether you're looking for a place to rent or you own a unit.

We think that's a feature rather than something to hide. You always know exactly who is handling your unit, and there's no front desk to get passed around.

2What Kondova does

We do two things.

We list condo units for rent. Owners give us their unit details, we publish them here, and people looking to rent get in touch through us.

We manage units for owners who ask us to. That means handling the tenant, arranging repairs, dealing with the building administration, and sending the owner a monthly statement.

Management is a separate service under a separate signed agreement. Nothing on this site creates a management relationship on its own.

3Who can use the site

You need to be at least 18 and legally able to enter a contract. If you're using the site for a company or another person, you're confirming you're allowed to act for them.

4Listings

We check every listing before it goes up. We confirm the unit with its owner or the owner's authorized representative. We do not publish a unit we haven't confirmed.

We still can't promise a listing is perfect or current. Rents change, units get taken, and details get updated between our last check and your reading it. We re-confirm listings regularly and remove ones we can no longer verify, but you should treat everything here as a starting point, not a final offer. Confirm the details directly before you pay anything or sign anything.

Some listings come from public sources. Where a unit was publicly advertised elsewhere, we confirm it with the owner before publishing it here. If you're an owner and your unit is listed here without your permission, tell us and we'll remove it the same day.

Photos may be indicative. Where a photo shows a similar unit rather than the exact one, we say so on the listing. If we haven't said so, the photos are of that unit.

5If you own a unit and submit it

When you send us a unit, you're confirming:

  • You own it, or you're authorized by the owner to offer it for rent.
  • The details you gave us are true, including the rent, the size, what's included, and when it's available.
  • You have the right to give us the photos you sent, and you're letting us publish them on the site and use them to advertise the unit.
  • The unit is genuinely available on the terms you described.

Listing is free. There's no cost to submit a unit, no cost to keep it listed, and no exclusivity. You can list elsewhere at the same time, and you can ask us to remove it at any time.

We can refuse or remove any listing, for any reason, without explaining ourselves. Usually that's because we couldn't verify it, the details didn't hold up, or the unit is no longer available.

Keeping it current is on you. Tell us when the unit is taken, the rent changes, or the availability shifts. If we can't confirm a listing is still accurate within 30 days, we take it down.

6If you're looking to rent

Sending an inquiry doesn't reserve anything and doesn't create any agreement. Units go to whoever the owner chooses, and the owner makes that decision, not us.

We may ask for basic information to pass to the owner: who you are, how to reach you, when you want to move in, and how many people will live there. You don't have to give it, but owners usually won't consider an inquiry without it.

We never charge you a fee to view a unit, to inquire, or to apply. If anyone claiming to represent Kondova asks you for money before you have a signed lease with an owner, that isn't us. Tell us immediately.

7Money

Rent goes directly to the owner. We do not collect, hold, or handle rent, deposits, advances, or any other money belonging to an owner or a tenant. When we manage a unit, we invoice the owner separately for our fee.

The one exception: if an owner specifically asks us to handle rent collection, that's a separate written agreement, and it doesn't apply unless they've signed one.

Anything you pay, you pay to the owner, into the account named in your lease. If someone gives you different account details in our name, stop and contact us first.

8Management fees

For owners who take up management, the current fees are shown on the site and confirmed in the signed agreement. The signed agreement is what governs. If the site and the agreement ever disagree, the agreement wins.

Fees for finding a tenant, where they apply, are discussed and agreed with the owner before any work starts. They are never charged to a tenant.

9What we are not

We say this plainly because it matters.

We are not a party to your lease. The lease is between the owner and the tenant. We don't sign it on anyone's behalf unless an owner has given us specific written authority to do so.

We don't guarantee rent, occupancy, or a tenant's behaviour. If a tenant stops paying, we chase it and we tell the owner right away, but the loss is the owner's.

We don't guarantee the condition of a unit or a building. Inspect it yourself before you commit.

We are not a bank, an escrow service, or an insurer, and we don't hold anyone's money.

10Your information

We collect what you send us: your name, contact details, and whatever you put in a form or a message. We use it to answer you, to connect owners and tenants, and to run the service. Nothing else.

We share an inquirer's details with the owner of the unit they asked about, because that's the point of the inquiry. We share an owner's details with a tenant when a lease is being arranged. We don't sell your information, and we don't hand it to anyone else unless the law requires it.

We handle personal data under the Data Privacy Act of 2012 (RA 10173). You can ask us what we hold about you, ask us to correct it, or ask us to delete it. Email touch@kondova.info and we'll deal with it.

We keep records for two years, because we may need them to resolve a dispute about a unit or a tenancy.

11What you can't do here

  • Post a unit you don't own or aren't authorized to offer.
  • Give false details about a unit, a rent, or yourself.
  • Use the site to advertise anything other than a genuine rental.
  • Copy, scrape, or bulk-collect listings, photos, or contact details.
  • Contact owners or tenants you found here for anything other than the rental in question.
  • Post anything that refuses or restricts a unit on the basis of religion, disability, health condition, family or civil status, or ethnic origin.
  • Impersonate us, or suggest we endorse or represent you when we don't.

We can block anyone doing these things, without notice.

12Limits on our responsibility

We run this site carefully, but we provide it as it is. We don't promise it will always be available, error-free, or completely up to date.

We're not responsible for:

  • A listing that turns out to be inaccurate, where we published it in good faith after verifying it.
  • What an owner or a tenant does, says, or fails to do.
  • Anything that happens under a lease we aren't a party to.
  • Losses from you relying on the site instead of checking the unit yourself.

Where we are responsible for something, our total liability to you is limited to the fees you actually paid us in the three months before the problem happened. If you haven't paid us anything, and most people using this site haven't, that limit is zero.

None of this limits liability that Philippine law says can't be limited, including for fraud or deliberate wrongdoing. We're not trying to write our way out of behaving honestly.

13Other sites and apps

We link to Messenger, Viber, and other services so you can reach us the way you prefer. Those are run by other companies under their own terms, and we're not responsible for them.

14Changes

We may update these terms. When we do, we change the date at the top. If a change materially affects owners with units listed here, we'll tell them directly rather than relying on them to notice.

Continuing to use the site after a change means you accept the updated version.

15Governing law

Philippine law governs these terms. If there's a dispute, let's try to sort it out directly first, and we'll make a genuine effort to do that. If that fails, the courts of Metro Manila have jurisdiction.
